PRIVACY POLICY

1. Purpose. This Privacy Policy (this “Policy”) applies to all personal information received by us whether through our website, SMS messaging service, social media accounts, by mail, or other offline methods. The Policy describes our policies and procedures for collecting, using, retaining, and protecting your personal information. By accessing our website, you are submitting your personal information to us, and you consent to the terms and conditions of this Policy. 

Our website or SMS messaging service may contain content, advertising, and other materials that link to websites operated by third parties. We have no control over those other sites, and this Policy does not apply to them. Please refer to the privacy policies of those sites for more information on how the operators of those sites collect and use your Personal Information. 

2. Types of Collected Information. We may collect and maintain the following types of information: 

 

     a. Name 

     b. Employer or organization name 

     c. Billing or mailing address 

     d. E-mail address 

     e. Phone number 

     f. Records of donations and volunteer services 

     g. Records of the provision of goods or services 

     h. Information about your operating system, your IP addresses, browser type and language, referring and exit pages      and URLs, keywords, date and time, amount of time spent on particular pages, what sections of a website you visit,        and similar information concerning your use of our website 

     i. Other information provided by you. 

 

 

Our website and SMS messaging service are not directed to children under the age of 13. We adhere to the Children’s Online Privacy Protection Act (COPPA) and will not knowingly collect personal information from any child under the age of 13. We ask that minors (under the age of 13) not use our website or SMS messaging service. If a child under the age of 13 has provided us with personal information, a parent or guardian of that child may contact us and request that such information be deleted from our records. 

If you choose to make a payment to us, you will be required to provide us with your payment information, including, without limitation, bank account numbers, credit card or debit card numbers, account details, ACH information, and similar data. 

3. How Information is Collected. We collect most of your personal information directly from you, whether in person, by phone, by text, or by e-mail and/or via our website and SMS messaging service. However, we may also collect information: 

 

     a. From publicly available resources and databases 

     b. Directly from a permissible third party (e.g., social media services) 

     c. From a third party with your consent (e.g., your bank) 

     d. From cookies on our website 

     e. From our IT systems (e.g., automated monitoring our websites and other technical systems) 

 

Like most websites, we may use automatic data collection technology when you visit our website to record information that identifies your computer, to track your use of our website, and to collect certain Usage Information. 

4. How Information is Used. 

 

     a. In General. Our use of personal information is limited to those uses that are consistent with this Policy and in furtherance of our mission. This includes, but is not limited to, the collection, use, and disclosure of personal information for the following purposes:

          ii. To process and maintain records of donations 

          iii. To send notices (such as acknowledgements of donations and tax statements) 

          iv. To send newsletters and promotional materials 

          v. To respond to your requests and inquires 

          vi. For marketing purposes, such as planning and managing events and other fundraising activities 

          vii. To analyze, enhance, and improve the use of our website and our services 

         viii. To create financial reports and projects 

          ix. For those purposes for which you have given consent 

          x. To protect our interests and legal rights and to comply with our legal and regulatory obligations 

          xi. To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any personnel, violations of our policies, or as otherwise required by law 

We will not sell, rent, or trade your personal information to any other entity. We will not send mailings to you on behalf of other organizations. 

We will use your payment information to process your authorized payments. 

     b. Mailing List. We may use your personal information to invite you to subscribe to our mailing list. If you opt in to receiving our communications, we may send you communications about our fundraising, programming, and other activities by e-mail, text, phone, or mail. You may opt out of our mailing list at any time by contacting us at saveadog@bdrr.org or clicking the “unsubscribe” link in e-mails or replying “STOP” in response to texts. 

     c. Disclosure of Personal Information. We Share Personal Information With: 

          i. Our affiliates 

          ii. Service providers and other third parties that assist in the operations of the organization, such as website hosts 

          iii. Third parties approved by you, including social media sites or third-party payment provides 

          iv. Credit reporting agencies 

          v. Our insurers and brokers 

          vi. Our bank(s) 

We may disclose your personal information and Usage Information to government authorities and to other third parties when compelled to do so by government authorities, at our discretion, or otherwise as required by law, including but not limited to in response to court orders and subpoenas. We may also disclose your personal information and Usage Information when we have reason to believe that someone is or may be causing injury to or interference with our rights or property, other users of this website or our services, or anyone else that could be harmed by such activities. 

We will share your payment information with a third-party service provider as necessary to process your payment. The third-party service provider stores your payment information; we do not store this information. Storage by the third-party service provider of your payment information is subject to the privacy policies and practices of the third-party service provider and is not subject to the terms of this Policy. By providing your payment information, you acknowledge and agree to use of your information by the third-party service provider for purposes of processing your payment to us. 

5. How Information is Retained. We will retain your personal information for as long as necessary to achieve the purposes described in this Policy. Donor files may be held for as long as their value outweighs the cost of retention. 

 

6. How Information is Protected. We take commercially reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no security system is impenetrable. We cannot guarantee the security of our databases or the databases of third parties with which we may share your personal information, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet. Please take special care in deciding what information you share with us. We will not be liable for unauthorized disclosure of personal information, including, but not limited to, errors in transmission of unauthorized acts of third parties. 

 

7. SMS/Text Messaging Policy. We will use your mobile phone number provided to us for SMS/text messaging purposes solely to communicate with you regarding our programs, services, donor opportunities, and other related business purposes. Mobile information, SMS consent, and text messaging opt-in data will not be shared, sold, rented, transferred, or disclosed to third parties for marketing or promotional reasons. 

     a. By submitting your personal information to us and opting in to our messaging service, you consent to the terms of this Policy and acknowledge that you have read, understood, and agree to this Policy. 

b. We do not charge for SMS messages, but message and data rates may apply from your mobile carrier. By opting in to our SMS message service, you approve any such charges from your mobile carrier. 

     c. You can opt out of receiving SMS messages at any time by replying “STOP” to any SMS message you receive. Once you opt out, you will no longer receive SMS messages, but we may contact you through other means such as email or phone. 

     d. By opting in to our messaging service, you agree not to use our SMS messaging service for any unlawful or abusive purpose. 

     e. We are not liable for any delayed or undelivered messages.

8. Changes to this Policy. We may periodically make changes to this Policy. Changes will be effective immediately upon being posted. To the extent permitted by applicable law, our use of your personal information is governed by the Policy in effect at the time we collect the information. Please refer back to this Policy on a regular basis.
